powerful, even riveting testimony from gabby giffords and her instruction to our committee, the judiciary committee and congress itself, to be bold, to be courageous, because america is counting on you. and the call to action that came from newtown is for better enforcement of existing laws but also new laws that will enable better enforcement. we can have common ground with mr. lapierre that better enforcement of existing laws is necessary, but that leads in my view inevitably for the call for more background checks on the 40% of all firearms purchases that right now are within the exemption of the gun show loophole and private sale and background checks on ammunition purchases. background checks, for example, and other sensible measures like stronger action against trafficking and straw purchases and including a ban on assault weapons are within the common ground that i think we ought to try to establish here. >> senator, for those just joining us, we have been keeping the coverage live going this morning of what's been taking place there on the hill with you and your colleagues. for th

also hear, gabby giffords, his wife, the former congresswoman may also make a statement. what do you want to hear in there today? >> well i think we've all believed for a long time there is, there is something that can be done, particularly in the area of background checks. we want to make sure that the criminals don't have access to guns. and those who are not, in a mental state, to have guns, they shouldn't have them. there are things that we can do there to broaden background checks that currently happen. so i hope that that's where we can make some progress the. martha: you don't hear that much about the mental equation here. who is really pushing for that out there and making their their priority in this discussion? >> well, there have been talks about that. it's a difficult, difficult, nut to crack. it really is. but, i got to make some progress there. i think that is where, like i say, if you want to really impact gun violence, that's where you can make a difference. martha: all right. senator flake, thank you. you have a busy day ahead. we appreciate you being with us, sir. t

ideas? last night after doing gabby giffords speech, he's from tennessee, i'm a huge fan of his. >> glen reynolds. >> glen reynolds said ask the question about the courage that gabby giffords is asking to be shown. glen said ask that question of democrats in red states that are running in 2014? are they going to have a political courage to do what gabby giffords thinks is the right thing on background checks, on high-capacity magazines, on assault weapons? >> i think it is unlikely that the congress will pass a ban on assault weapons. >> what about these democrats? how hard is it for the moderate democrats? >> speaking specifically of those democrats. i think they will have a hard time voting for a ban on assault weapons. i think willie's point about the background checks and the almost universal support makes it a much easier argument to pass. and two -- >> what about the high-capacity magazines? >> then on these big magazines, i think there's an agreement, a compromise, to be made for those who want to shoot and use those magazines at shooting clubs and while some may hunt with that, k
